<summary type="text">Local Democracy: The Reality of the Electoral System of Local Authorities in Sri Lanka

This study critiques the reality of the overall&#13;
nature, content and scope of the Local Authorities&#13;
Elections (Amendment) Act no 22 of 2012 and the&#13;
subsequent amendments thereto, in light of the concept of&#13;
local-level democracy. The quality of democracy at the&#13;
initiative level depends not only on the strength and the&#13;
coherence of the parties, and the party system but also on&#13;
the quality of the elections themselves. Therefore, this&#13;
article aims to analyse the extent to which the provisions&#13;
of the Act and the system of election complies with the&#13;
requirements of democracy. This research is conducted as&#13;
a literature review based on secondary sources using an&#13;
interpretative approach to support the arguments on&#13;
theoretical and doctrinal concepts. Moreover, the author&#13;
followed a qualitative approach to explain her stance in&#13;
this regard. In order to address the research question, the&#13;
author critically analyses the provisions of the relevant&#13;
Acts and its application in reality, which are lacking or&#13;
seems to be lacking in adherence to the concept of&#13;
democracy. As a result, the author finds that the system&#13;
experimented in the last local authorities election(2018)&#13;
delineate the delinquency of tenaciousness to the said&#13;
requirements to perpetuate a democratic society and&#13;
therefore, comes up with a proposal on how to shape up&#13;
the legislation to vouch for accountability at the local level&#13;
of governance to enhance the local democracy.

<summary type="text">The Right to an Informed Decision and its Lagging Legal Protection

An informed decision is when an agent makes&#13;
a substantive choice made with a reasonable&#13;
understanding of the potential benefits, detriments and&#13;
risks involved with the outcome of each available option&#13;
along with awareness of any relevant circumstances. It is&#13;
an important aspect of modern life on numerous&#13;
occasions such as medical treatment, business&#13;
transactions and life choices. The right to an informed&#13;
decision during medical treatment and scientific research&#13;
has long been recognized by the Nuremburg Code and&#13;
Helsinki Declaration as amended in 2013. Similarly the&#13;
Section 3 (c) of the UN Guidelines for Consumer&#13;
Protection of 1999 recognizes the right of informed choice&#13;
in consumer affairs. However, legal protection for the&#13;
informed decision during general life choices is still&#13;
lacking. When a superficial decision allows someone to&#13;
profit at the expense of the agent, denial of an informed&#13;
decision that could potentially serve the best interest of&#13;
the agent becomes a common malicious occurrence. This&#13;
paper looks at the protection the law can offer in such a&#13;
situation. The proposed solutions to remedy this include&#13;
the use of a two point legal test and declaration of the&#13;
informed decision as a fundamental rights. The&#13;
methodology involves the use of ethics to analyze the&#13;
violation of an informed decision, survey of existing&#13;
methods of protecting the informed decision and&#13;
formulation of a solution through jurisprudence.
